The Sickening Problems With Fiesta Mart in Texas

We've all run across items in a supermarket that are past their expiration date. It doesn't happen very often, and when it does (in my experience) the product is only a day or two past the date recommended by the manufacturer. Many grocery stores will mark items down when they get near their "sell by" date to move them out quickly. 

However, our friends at Tom Eats Houston found a supermarket that chronically keeps long-out-of-date food items on the shelves. Not just a day or two, but weeks out of date. That's beyond gross, it's potentially dangerous for the consumers who aren't careful about checking those dates. It could, possibly, lead to food poisoning or even death. 

The supermarket in question here is a store belonging to the chain Fiesta Mart, based in Houston. They have over 60 stores in Texas.  

The chain, reports Center Daily Times, "has been cited 13 times since 2015, according to an Aug. 15 news release from the U.S. Department of Labor’s Occupational Safety and Health Administration." 

“Despite painful and permanent injuries suffered by a half dozen of its employees since 2015, Fiesta Mart repeatedly ignores required safety standards,” OSHA Regional Administrator Eric S. Harbin said in the release. “The company now faces penalties of more than $1 million for their disregard of the law. Fiesta Mart must change the way it operates before more workers suffer serious injury.”

Given that apparent disregard for the safety of their own employees, it should not be surprising that Fiesta Mart shows no concern about their customers' safety by continuing to sell long-expired food items. 

In a blog post titled "Expired Food Too Common at Fiesta #39 in Houston," Tom Eats Houston (TEH) details a couple of times that food was left for sale on the shelves long past the time it should have been removed. Excerpts: 

Today [Jan. 11, 2023] I was in Fiesta Mart in Houston's Sharpstown neighborhood and found six cartons of liquid egg whites that expired weeks ago. 

This is their Store #39, at 8710 Bellaire, Houston, Texas. This store, in my opinion, is the worst supermarket in Houston and one of the worst I've seen anywhere in the United States. 

Five of the liquid egg cartons I found at Fiesta were marked "Use by 26 Dec 22," and one was marked "Use by 28 Nov 22" (six weeks and 2 days past safe usage). As with the expired sausages I found in August 2022 (see below), I took the expired cartons up front and left them with a clerk and when I asked for a manager I was told they were all in a meeting. I asked her to tell the managers that they're doing a lousy job of keeping expired food items off the shelves.

Over the past four years, I've come across numerous products at this Fiesta that are long past their "sell by" and "use by" dates. Do they want to be sued for food poisoning?

In the same post, TEH detailed a previous bad experience at the same Fiesta Mart in August 2022:

I found seven packages of sausages on August 30. Each had a "sell by" date of July 31. A month out of date. How did the staff miss this?

I've often found perishable items that are way past "sell by" dates at this store. Dairy, packaged meats, and other items. Do they not care? Are they lazy? Stupid? Do they put profit ahead of customer safety? I don't know. 

A couple of years ago, I found a packaged seafood item on a non-refrigerated display. The package clearly said, "Keep Refrigerated," and not just after opening. It was perishable. I pointed this out to a manager. His response shocked me. "Well, we don't refrigerate those in my country." Yes, well, ahem, we're not there.

You've been warned. Check those "sell by" dates, especially at Fiesta Mart #39 in Houston. It might keep you from getting sick – or maybe even from dying. 

If you're in Houston, you might rethink shopping at Fiesta Mart. Or, at the very least, carefully check expiration dates on the items you choose. That's good advice no matter where you buy your food.

Taco Bell Shell Hell: Licking a Public Relations Problem

June 4, 2013 - A photo of a Taco Bell employee licking a stack of taco shells has set off a public relations panic at the fast food chain's headquarters. The photo (right) was posted to the company's Facebook page on Sunday. The employee was suspended shortly after the photo was posted.

The shells were stale and about to be thrown out, but that has not stopped Taco Bell from going into full damage control mode, "conducting a full-scale investigation." See Taco Bell's  full statement below.

"It's unclear exactly where the image came from, although it was posted by someone named Jj O'Brien Nolan," reports Eater.com. It is not known at which restaurant the taco shells were licked, but Gawker reports that some Facebook commenters said the photo was taken at a store in Ridgecrest, California (map).

Woman Sues McDonald's in Oak Lawn IL, Claims Glass in Food

February 11, 2011 - Chicago - Glass in your McChicken Sandwich? No, thanks. But that's what a Chicago woman claims she got when she bit into her McChicken at an Oak Lawn McDonald's back in August. That's a southwestern suburb of Chicago, just south of Midway Airport. According to The Chicago Tribune today: A woman sued McDonald’s Corp , Friday, saying she was injured after chewing on a “large shard of glass” inside her spicy McChicken sandwich. Vjollca Lecaj said she suffered severe and permanent oral injuries, as well as “great pain and anguish,” after biting into and chewing the glass last Aug. 5 at a McDonald’s in Oak Lawn, Illinois, near Chicago. Full article... The news reports I've read omit the address of the McDonald's restaurant that allegedly served the McGlass Sandwich. I'm glad that I didn't get glass in my McDoubles when I dined at the Mickey Dee's near the CTA's Pulaski Orange Line station yesterday.

Heartland Cafe Blames City for Health Code Violations

March 15, 2009 - Late last week, a popular hangout for wannabe hippies, old hippies, progressive liberals, socialists and communists in Rogers Park was shut down for critical health code violations.

A female customer called 311 and said she'd gotten sick after eating at the Heartland Cafe, 7000 N. Glenwood, Chicago. City inspectors found mouse feces "throughout" the restaurant, mold slime in the ice machine (which was causing cross contamination in beverages), and at least one refrigerator that was not keeping food cool enough.

Now, the self-avowed socialists who own the dump claim that they are being persecuted by the City of Chicago. Like what, the inspectors planted the rodent crap and mold slime? The toxic restaurant has been in business for 32 years; you'd think they would know food safety procedures by now.

One local felt compelled to write this to me today: "This is a long time coming as far as I'm concerned. Maybe a good lesson in capitalism for the local commies. Or maybe karma coming back to Michael James for his pathetic and disgraceful treatment of musicians and artists. Wait...The tears are rolling down my face, I must get out my handkerchief."

Yesterday afternoon, I passed by the Heartland Cafe and saw co-owner Michael James puttering around at the front door (photo, right). That's the door on which city inspectors placed the big green "License Suspended" sticker. I heard Michael James make this mind boggling statement to a woman: "We've been in business 32 years....We'll learn from this and move on."

It took Michael James 32 years in the restaurant business to "learn" about mouse feces, mold slime and proper refrigeration? What about the false excuse that his Heartland Cafe is not to blame but is just being persecuted by the city? That seems a contradiction. If he's really being persecuted, why would he say he will "learn from this?" 

James isn't the only one making bad excuses. A tiny local socialist propaganda rag, "The Urban Coaster," a soon-to-be-defunct micro-newspaper also run by socialists, is happy to excuse the gross violations at The Heartland.

The Heartland Cafe is their biggest advertiser and Michael James writes the occasional column for them. Objective journalism knows no place at The Urban Coaster, as demonstrated in post on their website today. You don't believe Michael James is a socialist? Watch this video and let him tell you himself.

That post on the Urban Coaster's webiste said, "On March 12, the Heartland Cafe's license was suspended by a City of Chicago health inspector and its doors were temporarily closed. Owners Katy Hogan and Michael James have decided to use the city's action as an opportunity to make repairs ordinarily not possible during normal operations, such as resurfacing floors and cleaning large refrigeration equipment."

Resurfacing the floors, which should have been done years ago, is well and good, but has nothing to do with the mouse crap everywhere. So immediately, the Urban Coaster post attempts to divert our attention from the unsafe food practices at the Heartland Cafe. As for "cleaning large refrigeration equipment" that the nameless author cites, that should have been an ongoing procedure regardless of whether it was done "during normal business hours" or at other times. Obfuscation is a favored tactic of socialists, and it's in high gear at The Urban Coaster.

More from the Urban Coaster's post: "Michael James expressed a little frustration with City of Chicago inspectors taking the drastic action of shutting down his restaurant. He said that had they simply given him a week to make repairs, as has generally been their policy with restaurants in the past, he would have seen to it that the violations were corrected."

Look, a woman became sick last week from eating at the Heartland Cafe. She became sick not because the city is too tough on the Heartland Cafe. She got sick because the Heartland Cafe didn't care enough about customers' health and safety to keep the place clean or to maintain their refrigeration.... which Michael James is just now learning how to do after 32 years as a restaurateur.

How many other people became sick but never called 311 cannot be known, but thank God the city acted swiftly before someone with a weak immune system ingested a mouse crap burrito. It might have killed them. The city is obligated to shut down unsafe restaurants, and acted properly in this case. James, according to the propaganda piece in The Urban Coaster, complains about being given a week to correct the situation. That's not quite accurate you see, because in reality the shit-infested restaurant has has 32 years to "make repairs." 

The Urban Coaster shifted into melodrama with this: "The Heartland employs 50 people who serve the community organic food with a side of social activism at the corner of Glenwood and Lunt. In already difficult economic times the closure means the loss of a paycheck and the hardships that go along with that missing income for many of those workers. For the tightly knit community of Rogers Park, the affect of the loss of business from the locked doors is certain to ripple through many lives. To neighbors it also means the temporary loss of an iconic establishment."

We question the claim of employing 50 people, but the insertion of the phrase "organic food with a side of social activism" is obviously intended to rally the local communards to sympathize with restaurant that was endangering people's health.

You want organic? Mouse poop is organic. Mold slime is organic. Bacteria growing on food in warm refrigerators is organic. Eat up, activists! Do not panic, it's organic!

Let's address the issue of "the hardships that go along with that missing income for many of those workers" at the Heartland Cafe. Every one of them should be upset with James and partner Hogan for running a filthy joint, thereby forcing them to be closed in the interest of public safety. To The Urban Coaster, apparently, serious food poisoning would not "ripple through many lives" and is less important than having a comfortable place to dream about the violent overthrow of the United States.

As for the loss of an "iconic" establishment, well, Typhoid Mary is still iconic after all these years. The Heartland Cafe will remain an icon, but an icon forever more of shoddy food safety practices and "that place with the mouse turds everywhere." Perhaps Katy Hogan will be remembered as Mold Slime Katy.

The anonymous author of The Urban Coaster's column wraps up with this sappy statement:"Several passersby on Saturday said they feel strongly that Rogers Park needs the Heartland. Especially now, it needs Rogers Park."

Hey, pass that handkerchief, my eyes are tearing up. I wonder if the passersby noticed that the mock broken US Navy missile, which graced the rooftop for many years, has recently been removed? 

Does Rogers Park really "need" the Heartland Cafe? If so why? For what? Dry buffalo burgers? Slow, inattentive wait service and overpriced coffee? As a reliable disease vector? A place for illegal immigrants (excuse me: "undocumented trespassers") to work and take jobs from people here legally? They make it sound as if people will be lost without a nice place for America haters to congregate and plan their next anti-US rally.

"Especially now, it needs Rogers Park." Really? The Heartland Cafe should have thought about that a long time ago, before the mold slime started growing, before the mice had the chance to defecate "throughout" the restaurant, before the tofu went bad in the too-warm refrigerators, and before at least one customer became ill. Rogers Park needs the Heartland Cafe like a heart patient needs a cigarette.

Bloody Cock Meat, Damn!

As part of this weekend's Homo-Pa-Looza extravaganza here at The Bench, we're trying our hardest to find stories that fit. You know, stories into which that we can sensibly work words such as "blow," "hardest," "suck," and ... well, you get the idea.

This brief restaurant review should fit nicely. Sizzle on Broadway (a.k.a. The Pumping Company) serves food. Bar food. Decent for the most part. But watch out. The kitchen may or may not have tried to assassinate my last night.

I ordered the fried chicken special, a half chicken with mashed potatoes and gravy and garlic green beans. Those were okay, and I ate some of those while I let the fried chicken cool down a bit. The half chicken included one wing, of course, and I ate that, too.

I must assume that the meat was from a male chicken, also called a "cock." Hens (female chickens) are generally reserved for egg laying.

During the whole experience, the air conditioning ducts above me dripped condensed water down my back. I tolerated the one-drop-at-a-time rain shower with humor.

The supple, meaty thigh was still too hot to handle, which I realized as I picked it up to bite into it. I set it down and cut into it with a fork. That's when the blood oozed out of the chicken. Red blood, lots of it, oozed out. I cut into the breast and got the same result. I thanked my guardian angel that I did not bite into that undercooked chicken.

UPDATED: LOYOLA PARK BEACH OPEN FOR BUSINESS

FOOD VENDORS NOW WELCOME ON LOYOLA PARK BEACH!

CORRECTED/UPDATED - The Bench mistakenly said yesterday that this vendor was not licensed. In fact, there is a tiny permit on the cart. This only reinforces The Bench's assertion that Chicago Park District is selling out to push cart vendors along the beach.

This is great news for food vendors in Chicago.

This vendor set up shop on Saturday, May 24 at the south end of Loyola Park on Chicago's north side.

The vendor was back on Sunday, May 25 and Monday, May 26 - and why not? There's money to be made selling chips and soda and hot dogs at the beach.

This adds a whole new dimension to Rogers Park's already famous dining scene. And now - apparently - anybody can just set up shop on the beach! How long will it be before the Park District allows 20 more vendors onto Loyola Park's beach?

According to Chicago Park Concessions Management, to sell food you need several things. Their web site says, "Each concession must have at least two (2) persons certified with the Chicago Dept. of Health Certified Foodservice Manager Certificate." The Bench observed several periods when the vendor had only one person tending the food cart.

Dr. Soup Goes Espanol!

Finally! Congrats to former hypocrite Terry Feingold, caterer to the scum of the North Shore Political Machine. On March 6, Mr. Feingold followed strict orders from Joe Moore when he actually asked the new publisher of the News-Star newspaper if they had plans to print a Spanish-language version. But what about Feingold's own web site? "Thirty percent of the people in Rogers Park speak Spanish," Feingold said at the March 6 gathering to meet the new owner and editors of the News-Star. "Do you have plans to print a Spanish edition?" He was politely told that his suggestion was ridiculous, and one Latina in the room whispered to The Bench that the News-Star should print a Spanish edition as soon as La Raza ("the race") prints an English version. But when he asked the question, Feingold himself was guilty of ignoring "30 percent" of Rogers Park. The web site of his catering company, Gold'N Pear, was in English only. Was Feingold anti-Latino? Was his corn chowder and chipped beef on toast just too good for Hispanics? Well here's good news! The Gold'N Pear web site is now en Espanol! Check it out!

Jesse Jackson Protests Racist Traffic Signals

CHICAGO - Feb. 25, 2008 (The Bench) - Civil rights spokesman Rev. Jesse Jackson today lambasted the City of Chicago for it's "racist pedestrian signals."

"Why must we wait for a little white man to give us permission to walk?" asked Jackson. He stood at a crosswalk in Chicago's "Loop" business district and pointed across the street.

"Looka that," he said, "a little white guy tellin' me that I can walk. I resent that. I am somebody, not a nobody. I walk the walk. Can that little white man?" Jackson stepped into the street and crossed at a leisurely pace, talking to reporters as he moved to the other side.

"I call on all people to boycott these racist traffic signals," Jackson said. "Do not cross the street when he tell you to. Jus' stan' there. Don't cross til you see a little black man tell you to."

Phil Kosluzkzkchizyvk, a spokesman for the City of Chicago's Pedestrian Safety Office, said he did not understand Jackson's complaint.

"Can't he see that in fact it is a little black man outlined in white?" Kosluzkzkchizyvk asked. "We're very sensitive to this issue. In fact, we are actually experimenting with a black light crossing signal. It could be out in early 2009 if all goes as planned."

The US Centers for Disease Control and Prevention issued an update last week to its investigation of an outbreak of a paralysing condition that is affecting certain meat processing plant workers who use compressed air to remove the brains from the heads of pig carcases. Traffic Signal Needed, Joe Moore Silent

Thirteen months ago, The Bench posted a video (below) proving that the stop sign in front of a grade school is rarely obeyed. There has never been a traffic light at the intersection of W. Pratt and N. Greenview. Joe Moore has been alderman for 16 years, and he's done nothing about it. As of today, that video has gotten over 5,800 views on YouTube. Moore's people have seen it. Moore's office is aware of the dangerous intersection. Moore's office has done nothing about it. Ald. Moore's recent announcement of a traffic light to be installed on Clark Street, therefore, is a cynical and hypocritical gesture. He either doesn't care about the safety of the children crossing through Pratt & Greenview or he's a moron. Or both, maybe.

School starts tomorrow, Tuesday, September 4. When will 49th Ward Alderman Joe Moore decided that it's past time to put a traffic light at the intersection of N. Greenview and W. Pratt? Before or after a tragedy?

Michael James has no more excuses, despite what his protector and political officer Katy Hogan screams on the street corner. 

On June 12, Craig Gernhardt reported on his blog that Michael James, co-owner of the Heartland Cafe in Rogers Park, was renting a five-car garage to the people who operate those little plywood pushcarts, selling Mexican corn and mayo to unsuspecting people on the street.  

The next day, June 13, I ran into Gernhardt at Common Cup, a cafe on W. Morse Avenue in Rogers Park. As we sipped coffee outside, an agitated Katy Hogan dashed across the street to confront Craig. Hogan gave me a dirty look, then blasted Craig.

Hogan, James's partner in the Heartland Café, asked Craig why he linked the questionable operation of the pushcart garage to the Heartland. Craig correctly answered that he didn't, he simply (and accurately) noted that the owner of the garage is a well known local restaurateur. 

Hogan yelled that Michael James should not be held responsible for the operation, since he "didn't know" what was going on in the garage he owns. Well, it's been a month since Craig broke the story. 

Michael James certainly knows about this operation by now, yet the filthy operation continues. We watched a pushcart lady docking her plywood cart in the garage a few nights ago. 

Now that Michael James, co-owner of the Heartland Café, is fully aware that food is being stored in his uncooled, unsealed, filthy rat-filled garage, what will he do about it? 

Our photos here, taken on July 11, show how decrepit the rotting garage is. Vermin can easily get into the structure. Food is stored in there, food you or your neighbors eat. Elotes, anyone?

China Pouts After Mom Scolds Them

WARNING: Some people might find this posting to be "divisive." It contains truth and fact, which may cause discomfort and stomach upset for some readers. Poison pet food. Poison farm animal feed. Extremely high lead levels in toys and pottery. Toxic fish, and so much more wonderful stuff from China. The U.S. has called for investigations and bans of Chinese products, especially food items, and other nations have done the same. The Chinese, embarrassed, are trying to turn this around by claiming that U.S. products coming into China are tainted. They're pouting now. The world caught them in the kitchen with unwashed hands, and they are embarrassed, even though China has already admitted that there is a serious problem with food raised or processed there. It's comparable to a five year old kid who's been caught with his dirty hand in the cookie jar. His mom just scolded him for grabbing a cookie with his grubby fingers. The kid turns it around by accusing his mother of baking crappy cookies. So the Chinese are now saying that U.S. products going into China "failed to meet the sanitary standards of China." China has sanitary standards? Ha! Excuse me for a moment, I'm going laugh uncontrollably. Okay, whew. That was good. Those Chinese can be funny when they want to, huh? That quote came from the Chinese "General Administration of Quality Supervision, Inspection and Quarantine." Talk about an oxymoron. Oh - my - God. "U.S. inspectors recently have banned or turned away a growing number of Chinese exports, including monkfish containing life-threatening levels of puffer fish toxins, drug-laced frozen eel and juice made with unsafe color additives. The same story quotes Neil Langerman, an officer of the division of chemical health and safety of the American Chemical Society. He was asked if China’s seizure was a retaliation for the recent U.S. actions against Chinese products. “There’s more to this story than meets the eye. This is political," said Langerman, an officer of the division of chemical health and safety of the American Chemical Society. “I’d see what China is doing as a retaliation to what the U.S. has done." The Chinese did not specify which U.S. products were contaminated, or even how or with what. They only said that contaminates have been found unacceptably high levels, without providing details. It seems that some Chinese officials got together in a hurry, decided to say something to save face, and put together some poor crafted lies. Pitiful. Where'd That Fish Come From?

WARNING: Some people might find this posting to be "divisive." It contains truth and fact, which may cause discomfort and stomach upset for some readers. I was in a restaurant the other night, one of the better ones in Rogers Park. They had a fish special on the menu, and I asked my server where the fish was from. "It's farm raised," came the answer. "Yes, but what country is that farm in?" I asked. He didn't know. The cooks in the kitchen didn't know. Yikes. I had the chicken. Even with the antibiotics, I'd rather eat U.S.-raised chicken than fish that might have been raised in China. A lot of fish being served in restaurants these days comes from filthy farms, or are processed in filthy factories, in places like China. A short article in The Daily Green sums it up: Five years ago, Congress approved a law that would require country-of-origin labeling for food. But under intense lobbying pressure, the law’s implementation was put off until September 2008. Now, as tainted pet food and toothpaste ingredients, fish and other foods and drugs from China have proved to be tainted, Congress is under pressure to hurry up already. Many have long called for such labels. Next time you're at a restaurant, ask where the catfish was raised. Which country, that is.

By the time we are in sixth grade, most Americans know that you shouldn't drink the water when you go to the Third World. Mexico, for example, where local hotel staff will warn you to drink only bottled water. Yet, many Americans are regularly buying food from Third World sources, often without knowing they are doing so. Chinese food products, to be blunt, are shit. Often literally, since much of the fish being exported from China marinates in feces-laced water where it is raised on fish farms. Where was that catfish or trout you had yesterday from? Those mushrooms you had on your pizza? Probably grown and packed in China. We are advised to ask our grocers and restaurants which country the fish – or other foods – originates from. Most good restaurants will know, since good chefs are very into this knowledge themselves and are proud to share the good news that their fish is not from a shit-infested agrifarm in China. The familiar stainless-steel carts are small and lack basic kitchen equipment, yet roughly 40 percent of New York's vendors handle foods that can be hazardous, according to city figures. Many show up in the morning with tubs of raw meat and poultry, which can carry disease-causing bacteria. Food is often left unchilled and unheated, ideal for the growth of E. coli, salmonella and other germs. And some vendors wash their hands so seldom that they use their sinks for storage space. Tests arranged by The New York Times on a random sampling of chicken, burgers and kebabs from vendors' carts showed significant undercooking in 39 of 51 cases -- meaning that bacteria would not be eliminated. Why are we buying food - any food - from China? The tainted food products that have been killing dogs and cats in the U.S. now threatens human consumers. People have been freaking out for years about mad cow beef or bird flu - neither of which has produced the catastrophes that were predicted. Yet food from China has been killing hundreds - if not thousands - of people every year for a long time. China has long had a bad reputation for food safety and sanitation. Again: Why are we importing food items from China? (AP) WASHINGTON - Federal officials on Friday placed a hold on 20 million chickens raised for market in several states because their feed was mixed with pet food containing an industrial chemical. Since March 16, more than 100 brands of pet food have been recalled because they were contaminated with melamine. An unknown number of dogs and cats have been sickened or died after eating pet food tainted with the chemical. Federal investigators have been trying to determine how much of the tainted pet food had been used in feed for hogs and chickens. Hog farms in at least six states may have received tainted pet food for use in feed. Those animals also have been barred from market. The USDA and FDA said this week that chicken feed in some farms in Indiana contained byproducts from pet food manufactured with contaminated wheat gluten imported from China. MORE (AP)... It is very difficult to supervise and control the manufacturing process of agriculture products produced by individual farmers; prohibited products and processes are widely used. Food-processing factories are problematic sources of contamination. Most such factories are small, isolated and unorganized. Most factories are not properly equipped to produce quality foodstuffs. Food distribution is not well organized. Chinese food management enterprises lack needed facilities and food distribution is managed with out-of-date methods. Food safety protection is relatively weak in the countryside. Criminals sell impure and bad foods at country fairs and in small shops. During the Fuyang milk powder incident, farmers’ rights and interests were seriously and directly harmed. Food safety problems have brought a bad reputation to Chinese foods in the international market. The recent consecutive reports about the incidents of Fuyang milk powder, Longkou noodles and Sichuan pickled vegetables have already drawn attention and brought serious concerns from Japan, the United States, Hong Kong and Macao.
